統一專利法院（UPC）上路後，歐洲專利訴訟策略已然劇變！面對技術與專利賽局，台灣企業準備好了嗎？
自 2023 年 6 月「統一專利法院（UPC）」正式運作以來，歐洲專利訴訟的規則已被改寫。無論是科技業、醫藥業以及中小企業全球市場、專利佈局都受到不少影響。好奇在這一年的實務運作後，究竟產生了哪些具指標性的判例？和標準必要專利(SEP)有關的FRAND 授權談判、初步禁令（Preliminary Measures）的戰場又發生了什麼變化呢？

🌟 主講人：Jan B. Krauß & Maximilian Weiss
兩位講者來自德國慕尼黑的 SKM-IP 事務所。SKM-IP 是由德國知名的專利律師團隊創立。
Dr. Jan B. Krauß 律師為SKM-IP 的共同創辦人之一，其擁有超過 20 年的頂尖事務所合夥人經驗，Dr. Krauß 擁有生物學博士學位，專精於生命科學領域的專利佈局，特別是在抗體技術、幹細胞研究以及 CRISPR/Cas 基因編輯技術的專利保護與異議程序（Opposition）方面，擁有極為豐富的攻防經驗，協助生技醫藥客戶進入歐洲市場；
而 Maximilian Weiss 律師則是SKM-IP 的合夥人之一， Mr. Weiss擁有物力學背景，擅長處理高度技術導向的發明。其執業範疇涵蓋了從傳統機械結構到尖端的醫療器材技術，以及涉及物理光學與軟體演算法的專利案件。
本場講座兩位律師將結合專利訴訟策略與第一線實務經驗，為我們揭開統一專利法院( UPC )上路一年多來的真實面貌，以及這場歐洲專利制度變革對台灣企業的實際影響。

The Unitary Patent and Unified Patent Court as a strategic IP tool in Europe – A Taiwanese perspective
(歐洲單一專利與統一專利法院：作為歐洲戰略性 IP 工具之台灣觀點)
With the Unitary Patent (UP) and the Unitary Patent Court (UPC), in June 2023 the long-awaited introduction of a pan-European system for enforcing patent rights has started. The UP is the only patent right in the world allowing a centralized and joint enforcement in several (17 at the moment) EC-member states at once. The seminar will introduce into the structure and function of the system, and will take a look at its current acceptance and case load. Selected cases will be discussed that have an effect on the European IP landscape, e.g. with respect to timing, preliminary measures, gathering of evidence, FRAND licensing, long-arm jurisdiction, costs, and the validity of UPs. Then, we will discuss possible strategic implications of the UP on patent filing, licensing and enforcement for innovative companies, SMEs, NPEs, and large companies, for example in tech and pharma. The presentation will conclude with an outlook for the system, followed by Q & A.
